Simon Foster

Simon is a solicitor in the Dispute Resolution Group. 

He has particular experience in contentious property matters and regularly acts for household name property developers and private individuals in matters involving:

-    disputed boundaries and land ownership;

-    other real property matters, including easements and restrictive covenants;

-    sale and purchase contracts;

-    landlord and tenant (commercial and residential) disputes;

-    misrepresentation and misdescription; and

-    matters of professional negligence arising from land transactions.

Primarily, but not exclusively, Simon also acts on behalf of the firm's residential developer clients in contentious construction work, including high value adjudications, and quasi-contentious property matters, such as planning enforcement and village green applications.

In addition to property matters, Simon is also experienced in commercial contract, partnership and intellectual property disputes in respect of which he has recently acted for, by way of example, a London tourist attraction, a local security service provider and an industry leading PLC.

Simon's recent reported cases include Frazer v Browne [2009] EWHC 2692 (Ch). Simon acted on behalf of the defendant in successfully defending claims firstly before the Adjudicator to HM Land Registry and subsequently on appeal before the Chancery Division of the High Court regarding the ownership of disputed land and the extension of existing rights of way arising from an historic mis-conveyance.
